LEGAL NOTICES

Heritage Lake is a master-planned community being developed by Menifee Development, LLC.  Individual neighborhoods will be built by Standard Pacific Homes, Woodside Homes, and other guest builders.  Builders intend to build homes within the square footage ranges listed, however actual home sizes are subject to change without prior notification.  Anticipated prices and specifications are subject to change without prior notification.  A Homeowner’s Association, financially supported by all residents, maintains common area landscaping and other common facilities (See Homeowner’s Association Budget, approved by the California Department of Real Estate for maintenance cost assessments).  Public facilities, including school district, and some roadway construction are funded by special taxes payable by homeowners.  All future facilities and development plans are subject to change.  No obligation to build future facilities should be inferred.  Road locations and improvements are based on the city-approved plans and are subject to change.  Models do not reflect any racial preference.  Prices and specifications subject to change without notice.

TERMS OF USE

PLEASE READ THE FOLLOWING TERMS OF USE CAREFULLY BEFORE ACCESSING ANY PART OF THE WEBSITE

1.  General Terms and Conditions.  The following terms and conditions (“Terms of Use”) govern your use of this website and the materials accessible on or from this website (collectively, the “Website”).  Please read them carefully before accessing any part of the Website.  Your access of the Website constitutes your agreement with and acknowledgement of these Terms of Use. If you do not agree with these Terms of Use, please do not access the Website.

2.  Equal Housing Opportunity. Neither Menifee Development, LLC, its subsidiaries, nor any of its other affiliates (collectively, the “Company”) makes any representation or warranty of any kind with respect to the materials and information contained on the Website. Your use of the Website is at your own risk.  Although the Company attempts to provide accurate information, the Website is intended to be for general reference and informational purposes only. The Company assumes no responsibility for errors or omissions in the content of the Website, and makes no commitment to update such information. Your sole and exclusive remedy for issues relating to the use of, or the material on, the Website shall be to discontinue accessing the Website and using the information or material obtained. You and the Company agree that the Company shall not be liable for any damages relating to your use of, or reliance upon, the Website or any of its content.  When utilizing the Website please keep the following in mind:

  • Product information may be incomplete.  In the interest of continuous improvement, the Company reserves the right to modify or change floorplans, materials and features without prior notice or obligation. Such changes may not always be reflected in the Website or our models. Applicable fees and charges may not be disclosed on the Website. For example, there may be homeowner associations supported by residents maintaining common areas and facilities for a monthly fee. Our projects may also be included in community facilities, landscape maintenance and similar assessment districts, which may be financially supported by residents.  Ask your sales representative for details.  Although every effort has been made to ensure that the prices and terms contained herein are accurate and current, at any time such prices and terms are subject to change, prior sale, selected lot premiums and/or predetermined options. Prices shown refer to the base house and do not include any optional features.  Photos and/or drawings of homes show upgraded landscaping and may not represent the lowest-priced homes in the community.  The Company reserves the right to make changes to its home designs and to build more or fewer homes than currently planned.  All renderings and floor plans in these materials are an artist’s conceptual drawings and will vary from the actual plans and homes built.  Square footage numbers are approximate and may vary depending on the standard measurement used.  The Company cannot control future development or guarantee the preservation of the natural environment surrounding its communities.  The Company does not guarantee that any communities with guard gates will be guarded in perpetuity or that the gate will provide additional security or protection for residents.  Views vary significantly by lot location and may be affected by future development.  The Company does not guarantee the preservation of any view or the natural environment surrounding any of its communities.  Promotional programs are typically available only on select lots at select communities, and typically are not available in conjunction with other offers.  Any photographs or renderings of people in these materials do not depict racial preference.  Please consult a Company Sales Representative for specific price or other information for each community.
  • The Company Undertakes No Duty to Keep the Website Updated. Product and other information, including availability is subject to change at any time. The Website may contain inaccurate, incomplete, or out-of-date information. Prices may increase or decrease at any time.  Postings to the Website are made at such times as determined by the Company in its discretion. Users of the Website should not assume that the information contained on the Website has been updated or otherwise contains current information. The Company does not review past postings to determine whether they remain accurate, and information contained in such postings may have been superseded.

4.  No Offer To Sell. No information or material on this Website is to be construed to be an offer or solicitation for sale.  All homes about which information is provided herein are subject to prior sale.  You must visit a Company sales office to purchase a home.  The information is provided for informational purposes only.

5.  No Tax, Investment or Legal Advice. The content and information presented on the Website is for informational and promotional purposes only and is not intended to offer specific tax, investment or legal advice of any kind. References to tax and other laws are intended to convey the gist of general rules only and do not describe the various exceptions, limitations and rules for special situations that frequently accompany such general rules.

The information may not, except under written license, be copied, reproduced, transmitted, displayed, performed, distributed, rented, sublicensed, altered, stored for subsequent use or otherwise used in whole or in part in any manner without the Company's prior written consent, except to the extent that such use is authorized under the United States and other relevant copyright laws. The Company's trademarks, logos, images, and service marks used on the Website are the property of the Company and may not be used without the prior written consent of the Company and without proper acknowledgment. All other trademarks and/or logos are the property of their respective owners.

9.  Governing Law. The internal laws of the State of California, without reference to any choice of law provisions, shall govern any claims relating to the materials on or the Website.

10.  Severability. If any term of this Agreement is declared unlawful, void or for any reason unenforceable by any court in any jurisdiction, then such term will be deemed severable from the remaining terms in such jurisdiction and will not affect the validity and enforceability of such remaining terms.

11.  Updates to Terms of Use.  The Company may revise these Terms of Use at any time, and all users will be bound by such revisions. Revisions will be posted on this Terms of Use page and users are responsible to review the page from time to time to ensure compliance.

1.  Overview.  The Company recognizes and respects the privacy of users of the Website.   The following privacy policy, as modified from time to time by us as described below (the “Policy”), tells you about the information that the Company collects through the Website, how we use that information and how you can opt out of certain uses of information we may collect.  If you access the Website you are consenting to the information collection and use practices described in this Policy, as modified from time to time by us. If we decide to modify this Policy, we will replace this Policy on this Website with the modified version.  You will know we have changed the Policy when you see a new “Updated” date at the top of the Policy. We encourage you to check the date of the Policy whenever you visit this Website so that you will know when you need to review the Policy for modifications.  Please note that this Policy applies to all information collected online by the Company.

2.  Information The Company May Collect About You.

We collect the following types of information on the Website:

  • "Personal Information" is information that is used by the Company to identify you individually, such as your name and address.

For instance, we may collect information such as your preferences regarding location, size and price of a new home.  When we collect such information, we will share it with third parties as is necessary to respond to your request.
  • Surveys. From time to time, we may collect information through online surveys, questionnaires or information requests on the Website. These surveys may request demographic information (such as age range, gender, areas of interest) and customer feedback. Participation in such surveys, questionnaires or information requests is voluntary and with each request you will have the choice of whether or not to disclose information. We may use such survey information to analyze the Website and to improve users' overall experience on the Website.
  • Administrative Purposes. We may collect and use information that identifies you personally when you submit comments, questions or suggestions through the Website. For example, if you submit questions to us or submit information requests we will use the information you provide to respond to you. 3.  Disclosure of Your Personal and Aggregate Information. 

Personal Information.  The Company will not sell or disclose your Personal Information without your consent except as set forth below.

  • Consultants. From time to time the Company engages consultants that may need access to the information we collect to perform their services for us, such as administering our mailing lists. We require that our consultants keep Personal Information confidential and use it only in accordance with the service agreement between the Company and such consultant.
  • Transaction Processing. When you complete an information request form or otherwise indicate to us that you want us to provide you with a product or service (such as a request to be included in mailings about our future projects), we share the data needed for you to receive the product or services you have requested.
  • Legal Requirements. We may disclose your Personal Information if required to do so by law or if we believe that such action is reasonably necessary to: (a) conform with the law, respond to claims or comply with legal process served on the Company or the Website; or (b) protect and defend our rights or property, including the Website, our employees, guests or the public.
  • Company Sale. Because information collected through the Website is a trade secret and asset of the Company, we may disclose or sell such information in the event we entertain the sale of the Company or some or all of its assets.

Aggregate Information: The Company collects "Aggregate Information" about you and your use of the Website whenever you visit the Company online. For instance, the Company may collect various forms of "click stream" information such as entry and exit points for our Website (i.e., referring URLs or domains), site traffic statistics, page views, impressions, and operating system and browser type. In addition, when users request pages on the Website, the Company’s servers automatically log the users IP address. An IP address is a number that is automatically assigned to your computer whenever you are surfing the Web.  The Company may collect, compile, store, publish, promote, report, sell, or otherwise disclose or use any and all Aggregate Information.  However, if the Company correlates any Aggregate Information to you, such information will be treated like Personal Information under this Policy.

4.  Cookies. 

The Company may make use of "cookies" on the Website. Cookies are small text files that are stored on a user's computer by a web server based on the permissions set in a user's browser software. A cookie itself is not designed or intended to read any information from a user's computer (other than the contents of the cookie); rather, it is an identifier used by the website that originally placed it on your hard drive. The actual contents of the cookie information can be retrieved by the same server to identify the computer and subsequently to customize, monitor, or regulate the use of a site based on information stored in the cookie and the host server. 5.  Security.  The Company uses reasonable efforts to store and maintain personal information to protect it from loss, misuse, alteration or destruction by any unauthorized party. We store no financial information or social security information on the Website.  When we do transmit your data, we use only secure servers using current encryption technology to encode your data safely. The personal data stored on our system is protected by a firewall designed to keep unauthorized users from accessing our network.

6.  Outside Links.  While on the Website, you may be referred to web sites other than the Company’s Website. A link from the Website to such a third party website does not imply endorsement of that site nor any ability to control that site's privacy practices. Be aware that third party websites may collect data and personal information and operate according to their own privacy practices. Therefore, you should carefully review the privacy policies of third party websites before submitting any Personal Information to them.

7.  Children.  To respect the privacy of children and to comply with the Children's Online Privacy Protection Act, we do not knowingly provide products or services  to children under the age of 13. The Website is a general audience site that is not designed nor intended to collect personal information from children under the age of 13. If you are under 13 years old, you should not request any information nor provide any Personal Information to the Website.
